Nest Ultrasound Studio understands the importance of proper prenatal medical care for both the expectant mother and the fetus. Therefore, in order to provide our clients with an appropriate, meaningful ultrasound screening, Nest Ultrasound Studio requires that you: certify by using this website that you are under the care of a physician or other healthcare provider concerning your pregnancy or suspected pregnancy and that you are not obtaining this ultrasound as a replacement for, or in lieu of, standard prenatal medical care, including but not limited to diagnostic imaging  You further certify that if you are seeking ultrasound services to determine whether you are pregnant, that you will not rely upon Nest Ultrasound Studio’s ultrasound as final confirmation of your pregnancy.  Rather, you agree to seek appropriate medical care concerning your suspected pregnancy to medically diagnose pregnancy.

As a further condition to receiving ultrasound services from Nest Ultrasound Studio, you hereby acknowledge, understand and agree to the following statements:

-This ultrasound: (i.) is an elective procedure that I have voluntarily requested, and (ii) is not intended to take the place of a diagnostic ultrasound or any other test or treatment that has been or may be recommended by your healthcare provider.

-Because of its elective nature this ultrasound is generally not covered by insurance. Therefore, advance payment is required.

-The technician who performs this ultrasound, while qualified to provide such ultrasound services, is not a doctor, nurse or healthcare provider, and cannot interpret, diagnose medical conditions, or otherwise offer medical conclusions regarding the images produced.

-As used by Nest Ultrasound Studio, this ultrasound is intended to provide enhanced images for the purpose of viewing fetal movement in utero. The technician will make no attempt to guarantee a medically inclusive ultrasound for fetal well-being.

-You understand that you are responsible for contacting your own healthcare provider if you have any questions concerning this ultrasound or any other aspect of your pregnancy.

-You understand that the quality of the ultrasound and the video depends upon many factors including, body tissue content, developmental stage and fetal position. You understand that Nest Ultrasound Studio does not guarantee the quality of the video, photos, or other image(s), or the ability to visualize any characteristics of the fetus.

As evidenced by your signature below, you understand that factors beyond our control may also affect the ability to accurately determine the gender of the fetus, and that Nest Ultrasound Studio can provide no warranty or guaranty as to the accuracy of any such determination. You further understand that while ultrasound is believed to have no harmful effect on the mother or the fetus, future research or other information may disclose harmful or adverse effects that are presently unknown.

As evidenced by your signature below, you understand that factors beyond Nest Ultrasound Studio’s control may also affect the ability to accurately visualize and capture images of  pregnancy, and Nest Ultrasound Studio can provide no warranty or guaranty as to the accuracy of such determination. You understand that you are responsible for contacting your own healthcare provider if you have any questions concerning this ultrasound or any other aspect of your pregnancy. The Sonographer who performs this ultrasound, while qualified to provide such ultrasound services, is not a doctor and cannot diagnose medical conditions or otherwise offer medical conclusions regarding the images produced.

Nest Ultrasound Studio’s Policy on Images, Return Visits and Refunds:

Nest Ultrasound Studio makes no guarantees or promises that any images (still or video) created during your ultrasound session will be similar to those you might have seen elsewhere, in our clinic, website or promotional material or that we can always meet your expectations. Every baby images differently, depending on its gestational age, position, fluid levels, and mother’s condition. We promise to make every effort to obtain the best possible images of whatever parts of the baby that can be seen.

Images:
As a client of Nest Ultrasound Studio understand that there are many factors outside the control of Nest Ultrasound Studio as it relates to images. This includes but is not limited to:

– Baby is persistently looking face down, i.e. towards your spine, making it difficult to see the baby’s face.

– Baby’s placenta may be covering a body part including their face or there may not be enough amniotic fluid in the region being imaged (including the face) that makes the images less than perfect.

Return Visits:
If the ultrasound technician is unable to obtain any images for the session, one additional scan can be scheduled within two weeks of the original appointment as deemed appropriate by the Ultrasound Technician. The additional scan may be offered at the discretion of the ultrasound technician. This additional session is offered at NO COST to the customer.

By using this website, I understand that if I am unable/unwilling to return for an additional  session, then I am still responsible for the cost of the ultrasound service. I understand that Nest Ultrasound Studio provides a service for which I am paying and as a benefit of that service produces images and recordings. I understand that if I accept the additional session, there is no partial refund whether or not the additional sessions produces favorable images. We will give you all recordings and video that we were able to capture of any parts of the baby, regardless of quality. Favorable images include partial view of baby’s facial features. We cannot guarantee full face shots or a specific level of clarity.

For gender determination, if the technician is unable to determine the gender, we will bring you back another day, at NO COST. The ultrasound technician may require that you wait at least one week to reschedule the additional visit if they deem it necessary to get a more accurate view due to the size of your baby. We will continue to bring you back for additional sessions at NO COST until we are able to get a good view of the gender. I understand that Nest Ultrasound Studio cannot guarantee the quality or quantity of the ultrasound images or recordings produced.

IN CONSIDERATION OF THE SERVICES RENDERED AND/OR TO BE RENDERED, BY USING THIS WEBSITE YOU ALSO AGREE TO RELEASE NEST ULTRASOUND STUDIO, ITS AGENTS, AFFILIATES, DIRECTORS, SUPERVISING PHYSICIAN, ATTORNEYS AND EMPLOYEES FROM ANY AND ALL CLAIMS OR CAUSES OF ACTIONS FOR INJURY, HARM, DAMAGE OR OTHER LIABILITY WHICH MAY RESULT FROM, OR WHICH ARE ALLEGED TO HAVE RESULTED FROM, THE SUBJECT  ULTRASOUND SERVICES, INCLUDINGBUT NOT LIMITED TO, THE FAILURE OF  NEST ULTRASOUND STUDIO TO ACCURATELY DETERMINE FETAL GENDER OR OTHER CHARACTERISTICS, OR TO ACCURATELY CONFIRM A PREGNANCY AND FROM ANY LIABILITY FOR AND ALL OTHER DAMAGES OR INJURIES RESULTING FROM THE SUBJECT ULTRASOUND SERVICES, REGARDLESS OF WHEN THOSE DAMAGES ARE INCURRED OR THOSE INJURIES SUSTAINED OR DISCOVERED..
